Judge Vladimer Khuchua: I want once and for all to manage the election environment and administration in such a way that any manipulation and illegal interference is excluded and not dependent on someone's good will

The court unequivocally and unequivocally believes that the voter did not have the right to vote, - Tetritskaro district court judge Vladimer Khuchua announced this during the announcement of the decision regarding the GYLA lawsuit.

According to him, once and for all, it should be possible to manage the election environment and administration in such a way that any manipulation and illegal interference is excluded and not dependent on someone's good will.

"The voter must know for sure, without any risk assessments or any other manipulations, that his choice will be free, hidden and he will have to express his free will without any objection. Today we discussed the issue only and only regarding the secrecy, the court unequivocally and unequivocally believes that according to the evidences conducted in the courtroom, with this election ballot, vote counting machine, this frame envelope, the voter did not have vote protection and vote secrecy.

I would like to point out here, for the attention of all parties, especially for the attention of political subjects, that it was revealed at the court session that a number of monitoring organizations, a number of political subjects do not serve the purpose of fulfilling the will of the Georgian people. The party, the representative of the monitoring organization, who is not present at the court session today, showed that he refrained from presenting certain evidence, as prescribed by the procedural law. Also, it was revealed that there is no appropriate respect for the court from the representatives of the public sector. None of the third parties who were involved in the district commissions are present at today's court session. As the party mentioned, it turns out that the members of this district commission have more important issues to discuss, which is completely unacceptable to the court.

Also, I would like to point out that the court noticed that many of the political subjects who observed the election process were not sincere and that the opposing political parties and political subjects supported each other for the wrong conduct of the election process, when other materials give a different interpretation.

Therefore, taking into account all this, the court has its own beliefs and ideas regarding the election process, and I would like to wish everyone, once and for all in this country, that all of us manage to conduct the election environment and the election administration in such a way that any manipulation and any illegal interference is excluded. . Not dependent on someone's good will, but excluded", said judge Khuchua.

In addition, the judge explained that the court requested the evidence on its own initiative and the parties did not file a motion on this.

"Also, I would like to clarify that no proper evidence was presented to the court. The court requested all the evidence on its own initiative, I considered it necessary and that's why. None of the parties presented any motion or any position in this regard.

Also, the most noticeable thing about the process is the fact that there may be some flaws in the election process and in general, in the legislation, which require more refinement. We should try our best to eliminate all this. This especially applies to the written correspondence in the case, when the Central Election Commission directly promises in writing that there will be different ballot papers in the election process. This case deals with very important issues - this is our right to vote, this is the decision of our future, and therefore the court believes that in this case there was a factual basis, which is that the mechanisms listed above did not allow the possibility to exclude anonymity, and there was also a legal basis, since the Constitution of Georgia, international agreements, election legislation provide a guarantee to the citizen of Georgia that his right to vote will be protected and the confidentiality of his expression of the will of the election will be guaranteed. No one has the right to interfere with that, nor should they. Therefore, we should all work in this regard", said judge Vladimer Khuchua.
