The Parliament had no right to vote for the certificate of authority at all. With this vote, they put themselves outside the constitution. This is called nothing else than usurpation of the government, which is also prohibited by the constitution, - this is how constitutionalist Vakhtang Khmaladze assessed the Parliament of the 11th convocation and its powers.

In the "360 Degrees" program of "PalitraNews", Khmaladze talked about what type of decision the Constitutional Court could have made, if it had prevented today's session. The constitutionalist explains that the parliament would have the authority to convene the parliament of the XI convocation if the constitutional court did not recognize the lawsuits as admissible.

"Until the Constitutional Court makes a decision, the Parliament has no right to discuss the authorization of the heads of the Parliament.

Let's say in which case the Parliament would have the right: if the Constitutional Court did not recognize these lawsuits as admissible, but the Constitutional Court did not do such a thing. Or if it was recognized as admissible, but then did not satisfy the claims, neither one happened nor the other, thus the Parliament had no right to vote for the recognition of authority at all. With this vote, they placed themselves outside the constitution. This is called nothing but usurpation of the government, which is also prohibited by the constitution.

All means must be used to the end. Every possible mechanism should be used, whatever comes into someone's head, so that he does not choose to be taken over by the government. Because this government may do something in the future that will put us in a very difficult situation, those who are already in a very difficult situation," said Khmaladze.

When asked whether it is possible to file a claim with the European Court of Human Rights in Strasbourg, Khmaladze explains that it is possible if there are the right plaintiffs.

"As far as I know, it is possible if there are the right plaintiffs." One thing I know is that there is a circle of entities that can appeal to Strasbourg regarding the elections. The fact that different influences are applied to the government so that it returns to the constitutional framework, I have to say one thing about it, that the constitution is the legal document that must protect our rights, but we must not forget that the constitution also needs protection. When someone tries to violate the constitution, we must uphold the constitution. who are we - People must protect us. It is written in the constitution that no one has the right to usurp the government. This is not written for nothing. Such things have happened and will happen," Khmaladze notes.

The constitutionalist sees the way out of the current situation in re-elections.

"The answer is simple: it is a re-election. Re-elections - this is an effective tool to get out of the political crisis, which is written in all constitutional law textbooks that special elections are appointed to overcome the political crisis, but this is not included in the chapter of "Georgian Dream", Khmaladze said.

Michał Kobosko - we hope that your government eventually would either choose the European way, the democratic way or would resign seeing the number, the size and scale of the citizens' protests
