Davit Kezerashvili: The decision of the Strasbourg court confirmed once again that my right to a fair trial was violated

The decision of the Strasbourg Court has once again confirmed that my right to a fair trial has been violated - the Strasbourg Court is not a superior court that hears and reviews national criminal charges, so referring to my conviction is unfair manipulation, as the Strasbourg Court does not judge at all on the essential side of the case, former Minister of Defense Davit Kezerashvili writes on social networks, responding to the decision of the Strasbourg court, according to which it was proved that Kezerashvili embezzled the funds intended for the army.

According to Davit Kezerashvili, the main thing for him was for the court to judge the obvious procedural violations identified in the instrumentalized justice process, which pointed to the political motivation of the process, "which the court confirmed with today's decision."

"Today, the decision of the Strasbourg court once again confirmed that the right to a fair trial, the fundamental principle of legal proceedings, was violated against me, which was the main purpose of my lawsuit. Violation of impartiality means that the case was considered in violation of the principles of objectivity and justice, which proves that the judgment of the Georgian court is motivated not by objective legal grounds, but by other illegitimate interests.

I would like to clarify for the public that the Strasbourg Court is not a higher instance court that judges and revises the verdict on the charge presented at the national level in a criminal case. Therefore, the reference to the confirmation of my guilt is dishonest manipulation, as long as the Strasbourg court does not consider the merits of the case at all. In this part, I would like to remind everyone that I was acquitted by both lower courts of the Georgian court in this case, and just to put pressure on political opponents and free media, they renewed the case through the Supreme Court with a completely unjustified three-year interval.

In the same case, the courts of France and Great Britain found that the Georgian government had been conducting political persecution against me for years.

That is why any manipulative and propagandistic interpretation of the decision once again confirms the political nature of Georgian justice. As I stated in 2021, after the politically motivated judgment of the Supreme Court, the main thing for me was for the court to judge the obvious procedural violations in the instrumentalized justice process, which indicated the political motivation of the process, which was confirmed by the court with today's decision.
