Anzor Kvaratskhelia, who is accused of throwing a so-called Molotov cocktail at police officers, was sentenced to prison as a preventive measure.
The mentioned decision was made by the judge of the Tbilisi City Court, Davit Mgeliashvili.
According to the judge, under the reasonable presumption standard, both factual and formal grounds exist for the use of the restraining order.
The state indictment demanded the use of imprisonment as a preventive measure against the detainee. According to Prosecutor Roin Khintibidze, the defendant threw a so-called Molotov cocktail at law enforcement officers.
According to the prosecutor, the case also includes a video recording of how he throws a "Molotov cocktail" and how it falls in front of the police.
There is a danger of hiding, destroying evidence and committing a new crime on the part of the accused party, which is why the court should have used imprisonment as a preventive measure against him.
The defense did not agree to the indictment motion. According to the lawyers, Anzor Kvaratskhelia has not committed any crime, and no relevant evidence has been presented.
The lawyers submitted a motion to leave Kvaratskhelia as a preventive measure, and the court was offered to use a bail of 10,000 GEL as an alternative.
For information, Anzor Kvaratskhelia was arrested under Article 353 of the Criminal Code, which refers to an attack on a police officer, during the investigation started within the current actions.
