The Georgian Dream bill expands the scope of drug crimes and toughens the penalties - increasing the terms of imprisonment.
Penalties are being toughened for both the illegal manufacture, production, transportation, transfer or sale of a psychotropic substance, its analogue or potent substance, the plant cannabis or marijuana, other narcotics, its analogue, precursor or new psychoactive substance.
Within the framework of the draft, Article 260/1 is being added to the Criminal Code, which defines the illegal manufacture, production, transportation and transfer of a narcotic substance, its analogue, precursor or new psychoactive substance as a separate offense. The punishment for the specified crime is being tightened.
Article 260/2 is also being added to the Criminal Code, which defines the sale of a psychotropic substance, its analogue or potent substance, cannabis or marijuana, another narcotic drug, its analogue, precursor or new psychoactive substance as a separate substance and/or assistance in the sale. In this case, the punishment for the specified crime is also being tightened.
A new article of the Criminal Code is being formed - Article 260/3. This article defines the sale of a psychotropic substance, its analogue or potent substance, cannabis or marijuana, another narcotic drug, its analogue, precursor or new psychoactive substance as a separate substance.
Article 261/1 will also be added to the Criminal Code, which defines the illegal manufacture, production, transportation or transfer of a psychotropic substance, its analogue or potent substance as a separate offence.
The responsibility for the illegal acquisition, storage, manufacture, production, transportation and transfer of a new psychoactive substance is being tightened.
It is also new that evasion of examination to determine the effect of the narcotic drug, its analogue or precursor, committed by a person subject to administrative punishment under Article 45 of the Code of Administrative Offenses or a person convicted of a crime under Article 273 of the Criminal Code, is punishable by a fine or community service for a term of 120 to 140 hours or imprisonment for a term of up to 1 year.
