Commission acts such as petty hooliganism, disobedience to the request of a law enforcement officer, as well as verbal insults to a state or political official, civil servant or public servant by a foreigner may result in his/her expulsion from Georgia and a ban on entry into Georgia for up to 3 years. This measure may also be applied to a foreigner if he/she violates the rules related to holding assemblies and demonstrations.
The planned amendments to the Code of Administrative Offenses, which are part of the legislative package prepared by the Ministry of Internal Affairs regarding foreign citizens, introduce two new types of penalties: expulsion of a foreigner from Georgia and ban on entry into Georgia. These penalties are applied in cases where a foreigner or a stateless person commits certain administrative offenses.
According to the draft law submitted to the Parliament, in case of a foreigner committing a violation of the law provided for in Articles 166, 173, 173/16 and 174/1 of the Code of Administrative Offenses, in addition to a monetary sanction, the expulsion of the foreigner from Georgia and the ban on the foreigner’s entry into Georgia may be applied.
In addition, monetary sanctions are being increased for certain violations. In particular, the presence of a foreigner or a stateless person in Georgia for a period of up to 3 months from the date of expiration of the legal stay will result in a fine of 1,000 GEL instead of 180 GEL and the ban on the foreigner’s entry into Georgia for a period of 6 months will also be applied as a penalty.
Under the current law, the presence of a foreigner or stateless person in Georgia for more than 3 months after the expiration of the period of legal stay entails a fine of 360 GEL. The proposed draft, however, defines different sanctions for the presence of a foreigner or stateless person in Georgia without a legal basis for up to a year and for more than a year.
More specifically, the presence of a foreigner or stateless person in Georgia for a period of up to 1 year after the expiration of the legal period of stay will entail a fine of 2,000 GEL and a ban on the foreigner entering Georgia for a period of 2 years, and for more than 1 year - a fine of 3,000 GEL and a ban on the foreigner entering Georgia for a period of 3 years.
The draft law submitted to the Parliament increases the monetary sanction imposed as a penalty from 100 to 500 GEL for violation of the rules of transit travel through the territory of Georgia by a foreigner or stateless person.
In addition, instead of 100 GEL, a fine of 2,000 GEL will be imposed as a sanction for inviting a foreigner or stateless person to Georgia by an individual or legal entity registered in Georgia, or providing services to him or using his services for the violation of the rules established for obtaining the right to live, work and study in Georgia.
