According to the Ministry of Justice, Mamuka Khazaradze and Badri Japaridze lost a dispute over the Anaklia Port case in the Washington arbitration institution.
“The Washington Arbitration (World Bank International Center for Settlement of Investment Disputes - ICSID) has issued a decision on the Anaklia Port case and fully satisfied the Georgian government’s demands.
This time, the Washington arbitration institution confirmed that the failure to implement the Anaklia Port project is entirely the responsibility of Mamuka Khazaradze, Badri Japaridze and their partners, and that there was no interference from the Georgian government in any way.
The arbitration tribunal fully shared the legal argument prepared by the Ministry of Justice of Georgia and established that:
The investor was fully responsible for financing the project, who, for his own reasons, failed to raise the necessary funds.
The investor was the sole bearer of the commercial risk of the project.
The government’s termination of the contract was lawful: the investor had repeatedly delayed the deadlines set for the construction. The state consistently supported the implementation of the Anaklia project during the term of the contract.
The legality of the criminal prosecution of Mamuka Khazaradze and Badri Japaridze for money laundering has not been questioned.
The state has not interfered with the attraction of investors (including an American investment fund) for the “Anaklia Development Consortium”.
Within the framework of the aforementioned dispute, Khazaradze and Japaridze’s Dutch partner Bob Meyer demanded payment of 64 million USD. However, the arbitration rejected all his claims and imposed on him the obligation to pay 6.5 million USD to the Georgian government.
The public is aware that exactly one year ago, the Anaklia consortium of Khazaradze and Japaridze lost the dispute with the state in the Paris arbitration institution, within the framework of which they were demanding the payment of 1.5 billion USD from the state budget.
The Paris arbitration also completely rejected the claims of the claimants and, on the contrary, imposed on them the obligation to pay 650,000 USD in favor of the state. Khazaradze and Japaridze did not appeal the aforementioned decision, they paid the imposed amount, thereby effectively admitting that the Anaklia port could not be implemented through their fault,” reads the statement.
