According to the Partnership for Human Rights, a psychiatric examination of detained activist Nino Datashvili will likely be conducted within the next week based on a court ruling.
As the head of Partnership for Human Rights and Nino Datashvili’s lawyer, Tamar Gabodze, told InterpressNews, the problem is that due to the operation performed on her spine, the prosecutor’s office decided to conduct a forensic psychiatric examination for Nino Datashvili.
“As of Friday, she had not been transferred; they usually do not transfer on weekends. Tomorrow I plan to visit her and I will have information on whether she will be transferred or not. In all cases, she should be transferred this week because, according to the ruling, the court set 30 days, and these 30 days include the time for research, transfer, and return. Accordingly, next week is the deadline that the enforcement officer must use. Therefore, we think that she may be transferred on Monday. Her health condition is serious because she has had surgery on her spine. The problem is precisely that because of the surgery on her spine, the prosecutor’s office decided to conduct a forensic psychiatric examination,” Tamar Gabodze said.
According to the lawyer, the prosecutor’s office spread disinformation, as if the lawyer had submitted documents regarding Nino Datashvili’s psychological instability.
“There is no such record in the medical document. With the consent of Nino Datashvili, we have published the medical document, which is on the organization’s website, where there is no record of instability,” Tamar Gabodze said.
As she stated, she has only psycho-emotional lability, which, according to the lawyer, is a concomitant condition of spinal disease, when a person has pain and expresses it with emotions.
“[The prosecutor’s office’s] statement contains incorrect information. The goal is probably to mislead the public, because an unstable condition is not read in medical records. We have made this evidence public, that there is no such record there. In addition, the goal is probably to justify the prosecutor’s office’s illegal decision. Of course, this is an illegal decision. Nino Datashvili is undergoing a psychiatric examination due to spinal surgery, and this decision was made by the prosecutor’s office,” Tamar Gabodze said.
In addition, according to the lawyer, the investigation launched against Nino Datashvili will never be objective, because “no witness who is not an employee of the court has been questioned.” According to the lawyer, Nino Datashvili, who has repeatedly requested to be questioned, has not been questioned.
