Lawyer: Nino Datashvili's health condition has deteriorated in prison conditions

Nino Datashvili's health condition has deteriorated in prison conditions - we have filed a motion to postpone the trial, as it is in her interest to be involved in the consideration of her case, - said activist Nino Datashvili's lawyer, Tamar Gabodze.

As the lawyer noted, the prosecution and the court, when considering a preventive measure for Datashvili, should have taken into account that being in prison would complicate her health condition.

“What Nino Datashvili’s lawyers have been saying for so long, that her health condition would deteriorate in prison conditions, has been proved, and when the prosecutor’s office requested detention, it was obliged to take Nino’s health condition into account. Today, it has been proved that her health condition has deteriorated. The judge read a letter signed by the chief doctor of the penitentiary, which states that Nino’s health condition is so serious that she cannot participate in the session. We, however, filed a motion to postpone the proceedings. It is in her interest to be involved in the consideration of her case.

We also had to discuss whether to allow or not the expert opinion, but the proceedings were postponed. This expert opinion was obtained illegally,” Tamar Gabodze said.

For information, Nino Datashvili was arrested on June 20 in Tbilisi City Court for the incident that occurred on June 9. She was charged under Part 3 of Article 353 of the Criminal Code of Georgia, which refers to assault on a public servant while performing his official duties.

The type and extent of the punishment provided for is a fine or imprisonment for a term of 4 to 7 years.
