The hearing for activist Nino Datashvili, detained on charges of assaulting a public official, was postponed again today due to her health condition.
Nino Datashvili did not appear at today's hearing. Consequently, the process was postponed to October 29.
According to Judge Tamar Mchedlishvili, a medical certificate was submitted from the penitentiary institution, indicating that a doctor stated Datashvili could not attend the hearing due to her health condition.
According to Datashvili’s lawyer, they visited her today, and nothing has changed; she has not been transferred to a medical facility, but treatment—a physiotherapy course—has been started in the penitentiary institution.
Judge Tamar Mchedlishvili reviewed the preventive measure imposed on the detainee and left it in force.
The prosecution again requested imprisonment for Datashvili. As prosecutor Tsiramua stated, there is still a risk of the accused committing a new crime or influencing witnesses. According to them, no new circumstances have emerged that would justify changing the preventive measure. Additionally, the prosecutor stated that Datashvili’s stay in the penitentiary institution does not worsen her health condition, and a physiotherapy device has been provided to address her health issues.
The defense disagreed with the motion. According to the lawyer, they will definitely submit a motion to the court regarding new circumstances.
According to the rights defender, Datashvili’s health condition has worsened in prison conditions, and the physiotherapy device provided is insufficient.
Furthermore, the lawyer stated that the prosecution is approaching Datashvili’s situation irresponsibly; she needed the assistance of two people to reach the meeting today, and seeing her in this condition was very difficult.
The prosecutor stated that the prosecution does not disregard anyone’s health. They did not claim that Datashvili is in good health or has no issues. As they explained, the discussion was about whether the individual receives the necessary services in the penitentiary institution.
According to the defense, Datashvili is unable to care for herself or eat.
For reference, Nino Datashvili was detained on June 20 due to an incident that occurred on June 9 at the Tbilisi City Court. She was charged under Part 3 of Article 353-second of the Criminal Code of Georgia, which pertains to an assault on a public official during the performance of their duties.
This offense carries a penalty of a fine or imprisonment from 4 to 7 years.
