The prosecution lacks the resources to individually justify the risks in each accused person’s case, stated Boris (Chele) Kurua, the lawyer of Irakli Chkhvirkia, one of the individuals detained in connection with the events at the October 4 rally in Tbilisi.
According to Kurua, he urged the judge not to apply any preventive measures against the accused, but the judge did not grant this request.
“The court imposed pretrial detention as a preventive measure on Irakli Chkhvirkia, a person who is the sole breadwinner and caregiver for his mother with a first-degree disability and his 87-year-old grandmother with a second-degree disability, using general justifications and sending him to prison.
The evidence presented by the prosecution is insufficient to even establish a reasonable assumption that this person committed a crime; he does not agree with the charges. His detention has caused far greater harm than what the court was supposed to protect.

According to Mariam Shatirishvili, the lawyer of accused Amiran Dolashvili, they will appeal the judge’s decision.
“As expected, the judge unreservedly adopted the prosecution’s position regarding the imposition of pretrial detention as a preventive measure. The motion was unjustified, claiming risks of absconding, committing new crimes, influencing witnesses, and destroying evidence. There was no individual consideration during the process; it was a conveyor-belt system of imposing pretrial detention. I am certain that when we receive the court’s decision, it will be unjustified because the prosecution’s motion was also unjustified. We will appeal this decision. We provided the prosecution with documentation regarding his health; he has undergone surgical procedures and requires systematic care and attention,” stated Mariam Shatirishvili.
For reference, the investigation regarding individuals involved in the events at the Atoneli Palace is being conducted under Articles 317, 222, 225, and 187 of the Criminal Code. Within the scope of this investigation, a total of 46 individuals have been detained.
