The health condition of the accused will be taken into account and considered, stated Nugzar Chitadze, the prosecutor in the case of four individuals detained during the October 4 rally: Amiran Dolishvili, Irakli Chkhvirkvia, Giorgi Khorkia, and Zakro Albutashvili.
According to him, the prosecution will review the medical documentation submitted by the defense lawyers to assess whether the accused’s health condition is compatible with detention in a penitentiary facility. A decision will then be made regarding any changes to the preventive measure of pretrial detention.
“The court imposed pretrial detention as a preventive measure for the four accused, thereby endorsing the prosecution’s position, citing the risks of committing new crimes, absconding, and obstructing the collection of evidence. In this case, there is ample evidence, including video recordings, expert conclusions, and interrogation protocols, which confirm the commission of the alleged acts by the accused.
We will review the medical documentation submitted by the defense lawyers to determine whether their health condition is compatible with detention in a penitentiary facility and make a decision accordingly,” stated Nugzar Chitadze.
For reference, the investigation regarding individuals involved in the events at the Atoneli Palace is being conducted under Articles 317, 222, 225, and 187 of the Criminal Code. Within the scope of this investigation, a total of 46 individuals have been detained.
