Nino Datashvili's health condition is critically severe; she is in a state of torment—it is unacceptable for the court to allow detention based on the prosecution's desire, stated Tamar Gaboz, the lawyer for teacher Nino Datashvili.
According to her, Nino Datashvili's health condition has deteriorated, for which the prosecution bears full responsibility.
Tamar Gaboz also stated that at today's court hearing, they will appeal to the judge with a motion to cancel the preventive measure imposed on Nino Datashvili.
"Nino Datashvili's health condition is critically severe; she is in a state of torment, which we have been talking about for the past four months, and our fears have been confirmed—her spine could not withstand her imprisonment. In addition to the fact that Nino is an innocent prisoner, I will not discuss this at the hearing; what is important is that Nino be released from detention. Imagine: you cannot move your neck or limbs, and you are in unlawful imprisonment. It is unacceptable for the court not to satisfy the defense's motion for Nino Datashvili to be immediately released from detention.
Nino may attend the hearing remotely because her health condition prevents her from being transported. She cannot move; she cannot turn her neck or limbs. Every day for her is enduring pain and suffering. It is unacceptable for the court to allow detention based on the prosecution's desire," Tamar Gaboz stated.
For reference, Nino Datashvili was detained in Tbilisi City Court on June 20 due to an incident on June 9. She was charged under Part 3 of Article 353 Secunda of the Criminal Code of Georgia, which pertains to an attack on a public servant while performing official duties. This offense carries a penalty of a fine or imprisonment from 4 to 7 years.
