The Government Administration will have the opportunity to request information containing tax secrets and personal data, including special categories of data, from authorized bodies.
Relevant legislative amendments have already been submitted to the Parliament.
Amendments are being implemented to the Law “On the Structure, Powers and Rules of Activity of the Government of Georgia”, the Law “On Personal Data Protection” and the “Tax Code”.
The legislative package has been prepared by the Government Administration.
The Government Administration focuses on the Government Efficiency Department created within its framework. The department cannot request the aforementioned data, which, according to the Government Administration, hinders the department’s function to perform important tasks such as identifying risks, collecting and analyzing data, implementing monitoring and control procedures, assessing compliance, economy, productivity, efficiency and transparency, and preparing recommendations and proposals.
“Identifying and assessing risks is not possible with superficial or public data alone. Effective implementation of work activities requires in-depth analysis of various personal and other types of data to show an objective and real picture.
The authority to request information will increase the quality of analysis, thereby enabling the department to issue evidence-based recommendations, reports and proposals. For example, the expenditure part of state procurement implemented in the country is characterized by an increasing trend. Over the past five years, the total amount of state procurement contracts amounted to 36.94 billion GEL. According to data from 2024 alone, state procurement of goods, services and works worth 8.14 billion GEL was implemented. The aforementioned authority will maximally contribute to the achievement of the set goals.
Accordingly, it is necessary for the Government Administration to have access to tax secrets or personal data, including special categories of data, from the authorized body specified by law, for the implementation of functions that are necessary in the process of facilitating control and that will be necessary to achieve the relevant legitimate goal," reads the explanatory note to the draft law.
The Parliament will consider the draft law in an expedited manner.
