Irakli Kirtskhalia - If the participants of the assembly do not agree to hold the assembly at the place or on the road proposed by the Ministry of Internal Affairs, they will be subject to administrative detention first, and then criminal liability

If the participants of a spontaneous or non-spontaneous assembly do not agree to hold the assembly or demonstration at the place and/or on the route offered to them by the Ministry of Internal Affairs and still hold the assembly or demonstration at that place, thereby restricting human rights and freedoms, the participant of such an assembly or demonstration will be subject to administrative detention for a term of up to 15 days, and the organizer will be subject to administrative detention for a term of up to 20 days. Criminal liability will be imposed for repeated offenses, - the leader of the majority, Irakli Kirtskhalia, stated at the briefing after the majority session.

According to him, the aforementioned initiative will be initiated to maintain the balance as much as possible, which will be adjusted both for the participants of the protest and for those people who "live a normal life".

"Within the framework of the majority session, we have discussed the current legislative amendments, which were initiated and will be submitted to the plenary session during the session days.

A very important amendment that I would like to inform our society about. This is an amendment to the Georgian legislation "On Assembly and Demonstrations" and the "Code of Administrative Offenses of Georgia" and according to the proposed amendments:

The organizer of a spontaneous or non-spontaneous assembly and demonstration will be obliged to warn the Ministry of Internal Affairs about the assembly or demonstration, instead of the municipal body.

After receiving the warning, the Ministry of Internal Affairs will be authorized to propose to the organizers of the assembly or demonstration a change in the place and route of the assembly in the event that the form, place or route of the proposed assembly poses a threat to public order, the normal functioning of state and public bodies, enterprises, institutions and organizations and/or transport, as well as the unhindered movement of people or human rights and freedoms.

If participants in a spontaneous or non-spontaneous assembly do not agree to hold a meeting or demonstration at the place or/and location offered to them by the Ministry of Internal Affairs and still hold the meeting or demonstration at that place, thereby restricting human rights and freedoms, the participant in such an assembly or demonstration shall be subject to administrative detention for a term of up to 15 days, and the organizer shall be subject to administrative detention for a term of up to 20 days.

In addition, for the repeated commission of a similar action, the participant or organizer shall be subject to criminal liability under Article 347 of the Criminal Code, namely imprisonment for a term of up to one year.

These amendments have been developed in order to maximally preserve the balance both in relation to freedom of assembly and expression, as well as for the maximum protection of the rights of those citizens who live their daily lives in our country.

We see that a specific, well-paid group of 300 people, on Rustaveli Avenue or various places, is trying to create maximum discomfort for our citizens, the majority who live a normal lifestyle.

This amendment will be introduced and discussed in an expedited manner, and this will be a response to those plans that are being cooked up in their so-called NGO heads", - said Kirtskhalia.
