Response to violence against students by teachers or other school staff to be regulated by a bylaw instead of a law

The issue of responding to violence against students committed by teachers or other employees of educational institutions will be regulated by a subordinate normative act rather than by law.

During the second reading of the draft amendments to the Law on General Education at a session of the Parliament’s Education and Science Committee, lawmakers agreed to revise the initiative under which a teacher or another employee of a general education institution whose contract is terminated due to violence against a student would be barred from employment in general education institutions for three years.

As stated during the committee discussion, the three-year restriction will be removed from the law, and regulation of the issue will be delegated to the Ministry of Education and Science.

“Discussions were held at the ministry regarding cases of violence against students by teachers or other educational institution staff. We believe it would be better to delegate this matter to the ministry and define specific actions in detail through a subordinate normative act. This will be much more effective. At the same time, monitoring will be easier. We will observe the practice and, if necessary, make relevant changes more intensively. The issue is very sensitive. This is not about criminal law matters. It would be appropriate to delegate the issue to the ministry,” said Deputy Minister of Education and Science Zviad Gabisonia at the committee session.

The amendments to the Law on General Education, which include new initiatives related to schools, will be considered by Parliament under an accelerated procedure.

The draft law was prepared by the Ministry of Education and Science.
