If a person does not receive a decision adopted within the framework of an administrative complaint in accordance with the established procedure, the decision will be published on the municipality’s official website and will be considered delivered on the 30th day after its publication.
Tbilisi Mayor Kakha Kaladze informed the public about this change today at a meeting of the city government.
“I would like to touch upon one important issue related to the non-delivery of decisions adopted within the framework of administrative complaints. Regardless of the size of the fine - whether we increase or decrease it for a particular offense - this mechanism will not have a preventive effect if the process does not reach its conclusion. Unfortunately, various circumstances have emerged in practice. For example, there are frequent cases when an offender deliberately avoids receiving an issued fine, which makes enforcement difficult. Therefore, we applied to the Parliament of Georgia to introduce legislative changes. I would like to take this opportunity to thank every member of Parliament for their support. We developed a draft law under which, if a person does not receive a decision adopted within the framework of an administrative complaint in accordance with the established procedure, that decision will be published on the municipality’s official website and will be considered delivered on the 30th day after publication,” Kaladze said.
According to him, Parliament has supported and already approved the draft law, and at today’s meeting of the municipal government, a specific rule will be adopted and sent to the City Assembly for approval.
“Under this rule, a decision adopted within the framework of an administrative complaint will first, of course, be sent to the complainant at the address indicated in the complaint. If the decision cannot be delivered to the complainant, it will then be published on the official website - Decisions.tbilisi.gov.ge. The decision will be considered delivered and duly notified on the 30th day after its publication on the official website. We believe this process will significantly facilitate the full enforcement of the law and will have a preventive effect against bad-faith offenders. Of course, we are not happy to fine anyone, but the law must be obeyed. In cases where violations are identified, we will act within the framework of the law and in accordance with it,” Kakha Kaladze stated.
