"The case we have investigated serves as the basis for a guilty verdict in the future," – stated prosecutor Ketevan Sonidze, who is handling the case of the late teacher Giga Avaliani.
According to her, the mother of the deceased teacher expressed a firm position to the judge regarding the accused.
"At today’s hearing, the victim’s legal successor, Eka Kupatadze, was questioned. Her statement was not only emotional and morally heavy, but we also heard legal assessments and conclusions drawn as a result of her logical reasoning. She also expressed a strict and uncompromising position regarding the punishment of the accused. The case investigated by us is the foundation for issuing a guilty verdict in the future," – said Ketevan Sonidze.
The prosecutor noted that the investigation is proceeding in various directions and the circle of detainees may expand.
"Regarding Giorgi Malania, he is a minor who appears in the case as a witness. He was preparing at Eka Kupatadze’s educational center, attended classes there, and was a close acquaintance of Nia Imnadze. Therefore, the victim has developed a suspicion that it was Malania who provided the attackers with Giga Avaliani’s residential address. The investigation is ongoing in this direction, and if his criminal actions are identified, the Prosecutor’s Office will be uncompromising and will not spare anyone if the question of someone’s responsibility arises. During the questioning, Malania confirms that he had telephone contact with Aleksandre Gabashvili, but he does not confirm that he knew anything about the anticipated attack.
As for Nia Imnadze, no final decision has been made yet. We are awaiting the results of the evidence. The investigation is working to determine whether Nia Imnadze had information before the crime was committed, as well as whether he had information about the commission of the crime. If all of this is confirmed and a chain of evidence is established, naturally the Prosecutor’s Office will not back down in this direction either," – stated prosecutor Ketevan Sonidze.
For information: In the case of Giga Avaliani’s death, law enforcement officers have detained a total of 4 individuals. Among them, Aleksandre Gabashvili has been charged under Article 117, Part 2 of the Criminal Code of Georgia, which implies intentional grievous bodily injury that resulted in the deprivation of life. Giorgi Rikadze and two other minors were charged under Article 376, Part 1 of the Criminal Code, which implies failure to report a crime by a person who actually knew that a serious crime was being prepared and had been committed.
According to available information, of the four minors detained in the murder case of the young teacher Giga Avaliani, charges against two have been upgraded. The case concerns D.Ch. and A.N., who were initially accused by the Prosecutor’s Office of failing to report the crime. The investigation now accuses D.Ch. of intentional grievous bodily injury committed by a group. Meanwhile, A.N. was initially charged with failure to report a serious crime, but has now been charged with failure to report a particularly serious crime, which is a heavier article and is punishable by imprisonment from 3 to 7 years.
