Archil Gorduladze: Not a single party is prepared to engage in a legal discussion; Berdia Sichinava attempted to explain how Giorgi Gakharia’s actions relate to their party; they are collecting denied motions to use them in Strasbourg

They are accumulating a large number of motions—so that, regardless of whether the claim is granted in whole or in part, they can take the matter to the Strasbourg court and attempt to use the denial of these motions as an argument. We are witnessing an attempt to stage this masquerade, and the public is watching it all unfold. This statement was made by Archil Gorduladze, Chairman of the Parliament’s Legal Issues Committee, following a Constitutional Court hearing regarding the potential banning of opposition parties.

He further noted that no representative from the opposition parties is prepared for a legal discussion; their objective is to politicize the legal process.

“Giorgi Gakharia’s party faces a problem regarding the very name—Giorgi Gakharia—that appears in its own title. The question arises: how can this individual’s past actions be linked to the party itself—a party that bears his name and identifies him as its leader? How do his actions relate to our party? Mr. Berdia attempted to explain this. At the same time, he has sought to introduce motions that actually strengthen our lawsuit; we have no issue with this—in fact, we welcome it. He is attempting to transfer the proceedings of two criminal cases—currently being heard behind closed doors at the City Court—to the Constitutional Court. From my perspective, this is simply out of the question, as the Constitutional Court lacks the jurisdiction to handle such matters. He also filed another motion for recusal—though I have no idea on what grounds it was based. Those watching the hearing will be able to judge this for themselves. Their goal is to amass as many legally flawed, baseless motions as possible—motions that the court will inevitably be forced to reject. Then, perhaps, they can ask one another who managed to file more. They are accumulating a number of such motions; the likely strategy is that—regardless of whether the claim is granted in whole or in part—they will take the matter to the Strasbourg Court and attempt to use the denial of these motions as an argument. We are witnessing an attempt to stage this masquerade, and the public is watching it all unfold.

In reality, none of the parties are prepared to engage in a legal discussion regarding any of the issues. Their objective—both in the past, throughout these last three days, and moving forward—has been to politicize the legal process, which stands in direct contradiction to the Organic Law and the legal order in general. Their statements, including those made during the proceedings, only serve to further substantiate our claim. That is a good thing; let them keep talking—our case will only be bolstered by even more evidence,” stated Archil Gorduladze.
