Tbilisi City Court sentenced Aleko Elisashvili to prison as a preventive measure

Tbilisi City Court sentenced one of the leaders of "Strong Georgia", Aleko Elisashvili, to prison as a preventive measure.

Judge Tamar Mchedlishvili made the decision in this regard, thus satisfying the motion of the prosecution.

Before making the decision, the judge informed Elisashvili of his rights as a detainee at the session, to which Elisashvili replied as follows: "When they arrested me, they should have read these rights when they kicked me into the car."

As for the prosecution's position, it requested that Elisashvili be imprisoned as a preventive measure.

According to the prosecutor, Aleko Elisashvili verbally and physically insulted Ali Babaev, a member of "Georgian Dream", in connection with his political activities.

According to him, "the prosecution has obtained evidence, including video evidence, which proves Elisashvili's guilt, therefore there are grounds to apply imprisonment to the accused".

According to the prosecutor, Elisashvili may commit a new crime if he is at liberty, and it is not excluded that he may influence the witnesses.

As for the bail, according to the prosecutor, the prosecution does not ask for bail, because the bail cannot ensure the fulfillment of the goals of the preventive measures.

As for the position of the defense side, according to the lawyer, Aleko Elisashvili did not object to the police during his arrest.

According to her, there is no reason for Aleko Elisashvili to have any influence on the witnesses if he is at liberty, and there is no danger of Elisashvili hiding.

According to the lawyer, Elisashvili's risk of committing a new crime is also excluded, including the fact that he has no previous convictions.

According to the defense side, if you look at the video evidence in the case, it is clear that Elisashvili is in a state of necessary repulsion during the conflict with Ali Babaev.

"Babaev takes an iron rod, sneaks up to Elisashvili to hit him," the lawyer said at the hearing, noting that "if there is any crime, it is only from the other side".

According to the lawyer, Ali Babevi insulted Elisashvili on political grounds.

Therefore, as Elisashvili's defense side noted at the session, there is no need to use the strictest restraining measure, which is why the court offered 3,000 bail as an alternative, although the plaintiff did not satisfy this request of the lawyers.

For information, Aleko Elisashvili was charged under Article 156, Part 2, Sub-paragraph "A" of the Criminal Code of Georgia (persecution of a person in connection with political activity, committed by violence), which provides up to three years of imprisonment.
