Salome Zurabishvili will not be provided with state protection for the next one year after the end of her presidential term

President Salome Zurabishvili, after the expiration of the presidential term, will not be provided with state protection for the next one year.

The representatives of "Georgian Dream" have initiated a draft law in the parliament, if it is adopted, the President, as well as the prime minister and the chairman of the parliament will no longer have personal protection after the termination of their powers, if the constitutional court, in accordance with Article 48 of the constitution, violates the constitution by her or in her actions the presence of signs of crime was confirmed.

The Parliament will consider and adopt the project in an accelerated manner this week.

According to the current edition of the Law "On the Special Service of State Protection", personal protection is assigned to the Prime Minister from the day of his appointment, and from the day of his election to the President and the Speaker of the Parliament, which is maintained for a period of one year after the expiration of the term of office or termination of the term of office, unless termination of power is the result of a violation of the Constitution or the commission of a crime.

According to the explanatory note of the draft law, it is mentioned that in order for the result of the termination of the authority in case of violation of the constitution and the authority of the relevant officials to be terminated before the deadline, together with the decision of the Constitutional Court, it is necessary to make a decision on the termination of the authority by the members of the parliament at the plenary session of the parliament, which requires the appropriate quorum. The initiators of the project indicate that in the absence of a quorum, a situation arises when, on the one hand, the relevant official violated the Constitution, this was confirmed by the decision of the Constitutional Court, and only because the quorum was not reached in the Parliament, the authority of the violator of the Constitution cannot be terminated.

"Accordingly, after the expiration of the term of office, personal protection is maintained for him, despite the fact that he was considered a violator of the Constitution by the decision of the Constitutional Court.

In order to solve the mentioned problem, in order for the resources of personal protection to be used effectively, at the same time, in order for the state not to have the obligation to preserve the special right of the official who violates the constitution, to enjoy the state protection, it is necessary to make a change", - we read in the explanatory card of the draft law.

For information, last year, the Constitutional Court confirmed the violation of the Constitution by President Salome Zurabishvili, however, the author of the constitutional lawsuit - "Georgian Dream" could not remove the president from her post due to the lack of enough votes for impeachment in the parliament, and therefore, Salome Zurabishvili kept the post of the head of state until the end.
