According to the leader of the parliamentary majority, Mamuka Mdinaradze, in cases of economic and financial crimes, the process of asset confiscation from the accused/convicted person, their family members, and affiliated individuals will be simplified in order to ensure compensation for the victim.
He stated that under the new legislative initiative, a person will not be allowed to leave the country until they compensate the victim. Mdinaradze explained that "this will be enforced through the use of an electronic bracelet."
"This initiative concerns individuals who have committed economic and financial crimes. Specific financial and economic offenses are listed, and in the case of such crimes, the process of confiscating property and material resources from the accused, convicted person, their family members, and associated individuals is simplified to facilitate compensation to the victim. In other words, if a person commits a financial or economic crime and causes harm to another individual, in order to simplify the process of compensating that harm, the confiscation of money or property from the offender, their family, or related persons will be made easier. If this used to involve lengthy procedures, including civil disputes that could last for years, now it will be simplified. Additionally, under this initiative, the prosecutor can petition the court, and the court may restrict the individual from leaving the country for a certain period. Specific timeframes will be defined, which will be based on double the statute of limitations for the crime. For example, a person may be prohibited from leaving the country for 6, 12, or 16 years, and compliance will be monitored using an electronic device, until the damage to the victim is compensated," Mdinaradze said.
When asked whether the case of Giorgi Bachiashvili inspired this initiative, Mdinaradze replied: "Yes, among others."
