The same judge who issued the ruling on Levan Khabeishvili’s detention must also deliberate on the preventive measure. This is a direct violation of the right to a fair trial, – writes United National Movement lawyer Lasha Tkesheladze on social media.

According to him, this constitutes a violation of Article 6 of the European Convention.

"The same judge who issued the ruling on Levan Khabeishvili’s detention must also deliberate on the preventive measure. This is a direct violation of the right to a fair trial. According to the case law of the European Court, this is a violation of Article 6 of the European Convention, which guarantees a fair trial,” – writes Lasha Tkesheladze.

For reference, according to the State Security Service, one of the leaders of the United National Movement, Levan Khabeishvili, has been detained on charges of publicly promising money in the form of a bribe to officials. The agency states that Khabeishvili’s actions reveal all the elements of a crime under Article 339, Part 2 of the Criminal Code, and he was detained as a defendant on the basis of a judge’s ruling. The offense is punishable by 4 to 7 years of imprisonment.
