Public Defender Levan Ioseliani welcomes the release of accused teacher Nino Datashvili from detention and has issued a statement in this regard.
As noted in the Ombudsman's statement, on October 28, the Public Defender submitted an amicus curiae brief to Tbilisi City Court, where circumstances related to Nino Datashvili’s detention were being reviewed, including relevant aspects of her health condition.
"The Public Defender welcomes the fact of Nino Datashvili’s release from detention. On October 28, 2025, the Public Defender submitted an amicus curiae brief to Tbilisi City Court. The brief reviewed international and national human rights legal standards. It was pointed out that detention cannot be based on abstract risks or threats, nor solely on the nature and character of the alleged act. The use of detention is inadmissible unless there are relevant and sufficient grounds for its application, and the existence of risks must be substantiated with evidence of even higher intensity when detention is prolonged. The amicus curiae brief addressed the specific circumstances related to the detention of accused Nino Datashvili, including relevant aspects of her health condition," the Ombudsman's statement reads.
For reference, the court replaced the pre-trial detention imposed on accused Nino Datashvili with a lighter preventive measure and set bail at 5,000 lari. Nino Datashvili was detained on June 20 in connection with an incident that occurred on June 9 at Tbilisi City Court. She was charged under Part 3 of Article 353 Secunda of the Criminal Code of Georgia, which refers to assault on a public servant during the performance of official duties. This offense carries a penalty of a fine or imprisonment from 4 to 7 years.
