Constitutional Court accepted lawsuit filed by Zviad Gamsakhurdia's family

The Constitutional Court of Georgia has accepted a lawsuit filed by Zviad Gamsakhurdia's family. Lawyer Amiran Giguashvili told InterPressNews that Gamsakhurdia's family sues against the decision of the Prosecutor’s Office, which refused to hand over the criminal case materials. The lawyer said a trail is scheduled for March 28, 2019.

Gamsakhurdia's family lawyer Amiran Giguashvili explains that in case the Constitutional Court satisfies the complaint, all the victims will be allowed to get criminal case materials and not be dependent only on the verbal information provided by the prosecutor, which in many cases, is not enough and deepens distrust between the victim and the prosecutor's office.

According to Amiran Giguashvili, the subparagraph ,,H’’ of the paragraph 1 of the Article #57 of the Criminal Procedure Code clarifies the right of the victim: To get the information about the course of investigation and get acquainted with the materials of the criminal case, if it is not in contradiction of the interests of the investigation. According to the lawyer, this article also includes the victims' right to receive information from the prosecutor both in verbal and written forms.

The investigation into the Zviad Gamsakhurdia’s case has been ongoing for 25 years.
