The rule of license-permit suspension is included in the "Weapons" law

The rule of license-permit suspension is included in the "Weapons" law. This will be related to the permit holder's mental illness, as well as alcoholism, drug addiction or toxic addiction.

The legislative package was presented to the Parliament by the Ministry of Internal Affairs.

Taking into account the project, in the case of receiving data on the occurrence of any of these circumstances through the unified information base, the legal force of the license or the permit to purchase (with the right to store and carry) weapons will be automatically suspended. The right of the permit holder to dispose of weapons in accordance with the law will be preserved for a period of 30 days.

More specifically, within 48 hours of receiving information about the non-compliance of the health status of the permit holder with the requirements defined by the legislation, the service agency of the Ministry of Internal Affairs will be obliged to notify the relevant territorial body of the Ministry of Internal Affairs about the suspension of the permit.

After receiving the notice, the authorized person of the territorial body of the Ministry of Internal Affairs will appear at the place of residence of the holder of the weapon permit/place of storage of the weapon and inform the holder of the permit about the suspension of the permit. Along with the notification of the suspension of the permit, the authorized person will confiscate the weapon.

The person will be obliged to allow the authorized person of the territorial body of the Ministry of Internal Affairs to enter the place of residence/weapon storage for the purpose of confiscating the weapon. In case of resistance, the authorized person of the territorial body of the Ministry of Internal Affairs will have the right to use coercive measures in accordance with the Law "On Police".

If the person does not allow the authorized person of the territorial body of the Ministry of Internal Affairs to confiscate the weapon at the place of residence/weapons storage place, the corresponding permission will be revoked.

In addition, according to the draft law, a 30-day period will be determined from the moment of the notification of the license suspension to the permit holder, in order to eliminate the reason for the suspension and ensure the disposal of weapons in accordance with the law.

Eliminating the grounds for suspension may mean editing, deleting, etc. of relevant data about a person in the unified information base.

If the license holder does not provide elimination of the grounds for suspension within 30 days from the moment of the notification of license suspension, his license will be revoked.
