The Public Defender addressed the Minister of Internal Affairs with a proposal regarding the production and publication of complete statistical data on the use of administrative detention

According to the information of the Office of the Ombudsman, on November 18, the Public Defender of Georgia submitted a proposal to the Minister of Internal Affairs of Georgia regarding the production and publication of complete statistical data on the use of administrative detention.

According to the statement, statistical data should be processed in such a way as to reveal information about the number of detained persons who were not placed in temporary detention facilities.

"The Office of the Public Defender of Georgia considered the statement of the Social Justice Center of the Ministry of Internal Affairs of Georgia regarding the limitation of the right of access to public information. According to the information published on the website of the Ministry, the number of persons arrested for the offenses provided for in Articles 166 and 173 of the Code of Administrative Offenses is not determined (because not all arrested persons are placed in temporary isolation). Without quantitative data, it is difficult to assess the extent of the problems of both detention and the extension of the detention period.

The Public Defender of Georgia has been pointing out the challenges related to the legality of administrative detention in parliamentary reports for years and notes that the harmful practice of detention is used against participants of various peaceful gatherings.

The Public Defender of Georgia requested the Ministry of Internal Affairs of Georgia to: produce complete statistical data on the use of administrative detention provided for in Article 245 of the Code of Administrative Offenses (including complete statistical data reflecting the facts of arrest of persons who have committed violations of Articles 166 and 173); At the same time, the processing of statistical data should be carried out in such a way as to reveal information about the number of detained persons who were not placed in temporary detention isolators;

"Processed information/statistical data should be published quarterly on the official website of the Ministry of Internal Affairs of Georgia," the statement said.
