The court's decision regarding Mikheil Saakashvili is the execution of a command issued by Ivanishvili – any criminal evaluation or qualification of Temur Janashia is an unlawful decision, said lawyer Beka Basilaya, commenting on the court's decision regarding Mikheil Saakashvili and Temur Janashia in the budgetary funds embezzlement case.
As the lawyer told journalists after the court session, with this decision, "a political order was formalized and completed."
"The message from 'Georgian Dream' is that as long as they are in power, Mikheil Saakashvili should not see the light of day and should remain in political captivity. Today, we heard this. This is not a political evaluation because when we listen to the court and hear the arguments for why this decision was made, the court speaks about a maximum of 10% of the case, and we didn’t hear any explanation about the other 90%. We didn’t hear an explanation, including about the armored vehicles' expenses. When they say 9 million was embezzled for renting armored cars for the president's security, is this not a security measure? When they talk about personal expenses – is hosting Donald Trump, Joe Biden, Hillary Clinton, and others personal expenses? And so on, we could go on for an endless time," said Beka Basilaia.
He added that delegations from neighboring countries of Georgia also visited, for whom expenses were also incurred.
"Therefore, the court's decision is the execution of an order given by Ivanishvili. As for Temur Janashia, we stated from the beginning of the trial that the prosecution of the head of a militarized institution, based on orders from the Commander-in-Chief, is legally incorrect, regardless of the direction of qualification. It is incorrect because we later had practice, and evidence was presented in court, for example, that Anzor Chubinidze would have spent the same type of funds, and it is impossible for the state security service not to carry out the orders of the official under whose subordination they are. For example, we also presented how Mikheil Mgebrishvili carried out the instructions of Prime Minister Gharibashvili when he was head of the service."
"The court is not fair. Any criminal evaluation or qualification of Temur Janashia is an unlawful decision," said Beka Basilaia.
The Tbilisi City Court sentenced the third president, Mikheil Saakashvili, to imprisonment for embezzling budgetary funds, while former head of the State Security Service, Temur Janashia, was fined 300,000 GEL. The decision was announced by Judge Badri Kochlamazashvili.
The prosecution accused Saakashvili and Janashia of embezzling a large sum of 9 million GEL from thestate budget.
