Parents of children with Duchenne - The court rejected our request to suspend the decision of the Ministry of Internal Affairs on the restriction of the right to bring tents into the open park - we will appeal the decision

Parents of children with Duchenne muscular dystrophy are appealing the decision of the Tbilisi City Court, according to which the court refused to satisfy their application, to the Court of Appeals.

According to the parents, they field an application with the court, by which they requested the suspension of the decision of the Ministry of Internal Affairs to not allow the parents to set up tents in an open square.

“For 19 days now, we, the parents of children with Duchenne, have been holding a continuous demonstration in front of the State Chancellery, demanding funding for the necessary treatment to prolong the children’s lives.

The Ministry of Internal Affairs did not allow us to set up tents in the open park on the grounds that it would disrupt the functioning of the enterprise or organization.

It is worth noting that the nearest building is located 70 meters from the demonstration. Accordingly, it is unclear which enterprise or organization may face a problem. We appealed these instructions to the court and demanded that they be suspended. We pointed out that the constant presence of people, including women and children, in the open air in bad weather conditions may endanger their lives and health.

The court of first instance rejected our application on the grounds that we could not prove what harm we would suffer from the lack of tents.

This decision of the Ministry of Internal Affairs and the court is illegal, unfounded and it contradicts both the Constitution of Georgia and international law. We will appeal these decisions to the Court of Appeal.
