Pre-trial detention has been ordered by the court for Saba Bochorishvili and Givi Gudadze, who were arrested on drug charges in the case of the death of Abkhazian blogger Daur Buava.

The decision was made by Tbilisi City Court Judge Davit Kurtanidze.

The decision to impose preventive measures on the detainees was discussed at today's session.

The prosecutor's office requested the use of the most severe preventive measure - detention - against both of them, while Saba Bochorishvili's lawyer requested the use of a lighter measure against him, while Givi Gudadze's lawyer requested his release on bail of 20,000 GEL.

As it turned out during the trial, both defendants are under suspended sentences and, according to the prosecutor, there is a risk of their continuing criminal activity, hiding, and destroying evidence.

According to prosecutor Mariam Koridze, the case involves drug crimes and the use of the drug. In addition, the state prosecutor also talks about a secret video recording, where, according to her, the defendants describe their actions in the video.

According to prosecutor Davit Kazarashvili, the defendants themselves claim that they kept some of the drugs, gave some to people who became ill, and one died.

According to Kazarashvili, Saba Bochorishvili was even hospitalized after taking the drug, and Givi Gudadze had a seizure.

“None of them did what they should have done, especially since they were calling their friend dead. Especially since, when they used drugs and became ill, they could have called the people they gave them drugs to and told them to warn them.

All this speaks to their attitude towards crime. They themselves took drugs and distributed them to others. Their freedom could also endanger the lives of other people.

I have a question, why didn’t they inform Daur Buava or the woman about all this when they got to the clinic or after they left the clinic?

When they heard about the death and were asking what happened to them, why didn’t they ask before then?” Kazarashvili said.

Saba Bochorishvili’s lawyer Giorgi Megrelishvili disagreed with this motion. According to him, it does not matter whether his client is under probation or not and that this crime belongs to a minor category. According to the lawyer, there is no risk on his part that he will obstruct the investigation or the administration of justice in the court.

Givi Gudadze’s lawyer did not agree with the prosecutor’s motion either.

According to him, he is saying something unpopular, but “a person has the right to life as well as to death.” According to the lawyer, the accused woman was given the drugs by his client, but “the deceased decided what dose he would take.”

Prosecutor Davit Kazarashvili addressed the defendants with a question.

“When you took this drug and became ill, why didn’t you visit those people?” - Kazarashvili addressed the defendants, however, they did not answer.

Before the hearing, Givi Gudadze's lawyer filed a motion to partially close the trial to the media. According to him, the coverage of the trial serves not to satisfy public interest, but to satisfy curiosity.

As for Saba Bochorishvili's lawyer, he did not express a position on the matter and stated that he would entrust the decision to the court.

The prosecution did not agree with the motion.

According to Prosecutor Davit Kazarashvili, on the contrary, there is a high public interest in this case, therefore, the public should be involved and, among other things, journalists should be provided with information.

"This case should be public and journalists should bring information to the public," the prosecutor said.

The judge did not satisfy the defense's motion.

According to the investigation, Daur Buava and the accused Valeria Kirilyuk consumed drug "Methadone" given to them by Givi Gudadze. During a search of his house, law enforcement officers seized a particularly large amount - 6.27 grams of "Methadone", which the accused had packaged into 9 packages in order to facilitate its sale.

As for Saba Bochorishvili, he illegally purchased and kept 0.24 grams of dried marijuana in his home.

For information, Givi Gudadze was charged under Article 260, Part Three, Subparagraph “a”, Article 260, Part Six, Subparagraph “a”, and Article 260, Part Seven (illegal purchase and storage of narcotic drugs in a particularly large amount, facilitation of sale and illegal transfer of narcotic drugs) of the Criminal Code of Georgia, which provides for a sentence of up to 20 years or life imprisonment.

As for Saba Bochorishvili, he was charged under Article 273 of the Criminal Code of Georgia (illegal purchase and possession of a small amount of narcotics by a person convicted of a drug offense). This provides for imprisonment for a term of up to one year.
