De-oligarchization requires not an individual, but a systemic approach, which implies that this improper influence must be fought in every space, wherever it exists. Secretary General of the Venice Commission, Simona Granata-Menghini, told journalists.
"First of all, we do not call this "de-oligarchization", for us it is a problem with the democratic life of the country, the presence of money in the public space... and in some cases this money damages the democratic process. We received a request for our opinion on the draft law on de-oligarchization of Georgia, after the opinion on the draft law on de-oligarchization in Ukraine, and there was a similar law in the Republic of Moldova as well.
The Venice Commission considered that the problem of undue influence of money in democratic processes should not be addressed in laws that target individuals. This is not how it works, we considered that it does not correspond to the standards of human rights, does not correspond to the principles of separation of powers and pluralism. So, having said that, you should not deal with the problem in this way. We have said that a systemic approach is needed, which means that this undue influence must be fought in every space, wherever it exists.
Individual laws and laws that target specific individuals are not the way to solve this. Out of the three laws - in Ukraine, the Republic of Moldova and Georgia – the draft laws in Georgia and Moldova were abandoned and it is not being implemented in Ukraine. Instead, strategies are being developed, systemic strategies that touch several spaces. There is such an action plan here and, I think, in Moldova as well.
We do not evaluate action plans, the Venice Commission evaluates legal texts, and this is not a law, so we are not going to evaluate an action plan [on de-oligarchization] in Georgia, just as we do not evaluate it in Moldova or elsewhere. This does not mean that we like or dislike it," she said.
