The Appellate Court upheld the City Court’s decision regarding the imprisonment of Nino Datashvili. This was announced in a statement by the "Partnership for Human Rights" (PHR).

According to the statement, the Appellate Court’s decision, like that of the first instance court, contains only general, vague, and abstract reasoning.

"The decision states that there is a risk of Nino Datashvili continuing 'criminal' activities, absconding, or influencing witnesses. However, neither instance of the court substantiates these risks with factual circumstances.

In the appeal, PHR highlighted all the circumstances proving that there was no risk of Nino Datashvili continuing 'criminal' activities, absconding, or influencing witnesses. Accordingly, the decision to apply imprisonment was unlawful.

The Appellate Court’s ruling explains that the risk of Nino Datashvili absconding or influencing witnesses is so high that the circumstances indicated by the defense do not mitigate these risks or affect the lawfulness of the imprisonment. However, the ruling does not specify what circumstances the Appellate Court relies on to assess these risks.

In its appeal, PHR noted that Nino Datashvili herself was a victim of physical violence by mandate officials, and thus an innocent woman was being held in custody. Additionally, PHR requested an oral hearing, as, despite Nino’s request, the judge at the court hearing did not explain the basis for refusing bail. The Appellate Court does not address these issues in its decision.
