Nino Datashvili requested on July 11 that the information provided about her not be made public, and accordingly, the Public Defender’s Office has not disclosed special category personal information regarding Nino Datashvili’s health condition, according to a statement issued by the Public Defender’s Office concerning the detained activist Nino Datashvili.

As stated in the information, representatives of the Public Defender visited Nino Datashvili, who is held in Penitentiary Institution No. 5, on June 27, July 11, and July 16. According to the Public Defender’s Office, during the meetings, Nino Datashvili discussed various issues with the representatives, and in response, the Public Defender’s Office contacted the General Prosecutor’s Office of Georgia, the Ministry of Internal Affairs, and the Medical Department of the Special Penitentiary Service for the purpose of addressing these concerns.

“It is noteworthy that on July 11, Nino Datashvili requested that the information provided about her not be made public. Accordingly, the Office has not disclosed special category personal information regarding Nino Datashvili’s health condition.

The Public Defender’s Office continues to monitor the rights situation of the accused and will take all measures to protect her rights within the scope of its legally defined mandate.

In addition to the above, the Public Defender wishes to address the recent targeted dissemination of false information about the institution, claiming that the Office does not respond promptly to violations of the rights of detained persons.

Given the high public interest, we would like to clarify the following: The dissemination of disinformation about the Office’s responses through social networks or certain media outlets causes particular harm to the process of protecting the rights of each detainee.

The Public Defender’s Office hotline operates 24/7. Any information received from closed-type institutions regarding alleged instances of ill-treatment or healthcare issues is met with immediate action. The Public Defender’s representatives conduct on-site visits and take initial response measures. Furthermore, subsequent actions are planned, including, if necessary, the involvement of a doctor employed by the Office.

The Public Defender, as the National Preventive Mechanism against torture, primarily acts in the best interests of detained persons and, in accordance with their requests, protects their personal information, including details about their health condition. Despite high public interest, information is disclosed only with the consent of the detained person.

It should also be noted that the Public Defender’s representatives have never had, nor do they currently have, the authority to conduct medical examinations in penitentiary institutions.

The Public Defender actively continues to oversee the protection of detainees’ rights, including their right to health,” the statement reads.

As a reminder, Nino Datashvili was detained on June 20 due to an incident that occurred at the Tbilisi City Court on June 9. She was charged under Article 353, Part 3 of the Criminal Code of Georgia, which pertains to an attack on a public official during the performance of their duties. This offense carries a penalty of a fine or imprisonment ranging from 4 to 7 years.
