The Public Defender, after examining the issue of restricting the right of communication with the outside world - including with children - for Levan Khabeishvili, has submitted a proposal to Parliament to regulate the matter

According to Public Defender Levan Ioseliani, following the examination of the issue concerning restrictions on communication rights for accused persons, including contact with their minor children, he has addressed the Parliament of Georgia with a proposal for legislative regulation.

As he explained during the presentation of the Public Defender’s 2025 report in Parliament, the law does not establish any specific regulation regarding the consideration of a defendant’s relationship with their minor children when imposing restrictions on personal life rights. However, he stressed that a clear rule should be defined, requiring investigative authorities to assess whether such communication restrictions should also apply to the defendant’s minor children.

“During the reporting period, we began studying another important systemic problem related to the automatic and blanket restriction of communication between accused persons and the outside world, including their minor children. This issue emerged in the case of accused Levan Khabeishvili, when, during pre-trial detention as a preventive measure, his right to communicate with the outside world - including with his minor children - was restricted. It is noteworthy that the law does not provide any specific regulation regarding the issue of communication with minor children when deciding on restrictions of a defendant’s personal life rights. It is necessary for the law to define a specific rule, according to which investigative authorities will be obliged, when deciding on restrictions of communication rights for an accused person, to consider the best interests of the child and, depending on the nature of the charges and individual circumstances of the case, assess the possibility of excluding minor children from such restrictions. In order to regulate this issue, I have also submitted a proposal to the Parliament of Georgia,” Ioseliani stated.
